GENERAL TERMS AND CONDITIONS ONLINE SHOP (GTC)

 

General

These general terms and conditions ( GTC ) regulate all legal relationships for purchase contracts concluded between MinaDays.com (seller) and its customers (buyers), whether in the online shop, by email, telephone or fax. Any provisions of the buyer that conflict with these GTC are hereby expressly excluded.

offer and delivery

The offer is visible on the MinaDays.com website and is non-binding. Product information is primarily for illustration purposes and is non-binding. We reserve the right to make price and product range changes as well as technical changes. The offers are only valid as long as they are visible on the website and while stocks last.

Orders and deliveries are only possible within Switzerland, Austria and Germany.

In the online shop, the buyer submits a legally binding offer to conclude a contract by submitting his order and simultaneously accepting these terms and conditions. The contract is concluded at the time the buyer receives an order confirmation from the seller by email. The delivery method and delivery costs are shown in the online shop.

Information on availability and delivery times is not binding. If an article is not available in stock, the buyer will be informed as soon as possible when delivery can be expected. The seller is not liable for delivery delays caused by manufacturers or third parties. All information on delivery times is therefore without guarantee and can change at any time. Delivery is at the buyer's risk and expense (no liability for loss, damage, theft, etc.). Shipment inquiries, delivery service claims and delivery service complaints are the responsibility of the customer.

 

Price information and payment

Prices from Switzerland are in Swiss francs (CHF), including VAT. For Germany and Austria, prices are in euros (EUR), including VAT. We reserve the right to change the published prices and conditions, with the day the order is placed by the buyer being the effective date.

Payment for the ordered goods is made in advance, either by credit card, PayPal, Twint, ApplePay, GooglePay, ShopPay. For online payments, the value of the goods is charged on the day the order is received. The seller reserves the right to exclude buyers from individual payment options without giving reasons.

When paying by credit card, the contractual and data protection provisions of Bankful www.bankful.com or Shopify Payments www.shopify.com apply .

When paying with Twint, ApplePay, ShopPay, PayPal, GooglePay, Klarna, etc., the contract and data protection provisions of the respective providers apply.

The delivered goods remain the property of the seller until full payment has been made. The seller is entitled to make a corresponding entry in the retention of title register. If the buyer defaults on payment of the purchase price, the seller is entitled, among other things, to withdraw from the contract and repossess the goods.

The order is placed in the following steps:

  1. selection of the desired goods
  2. Confirmation by clicking on the field «Add to cart»
  3. Checking the information in the shopping cart
  4. Confirmation by clicking on the "Checkout" field
  5. Selecting the payment method and entering the buyer's data
  6. Re-examination or correction of the respective entered data
  7. By clicking on the “Buy Now” field, the order is transmitted bindingly, payment is made and the general terms and conditions are accepted.

Confirmed orders can no longer be cancelled or changed by the buyer.

 

Warranty and Liability

Complaints about defects or incomplete or incorrect deliveries must be reported to the seller in writing immediately, but no later than 3 days after delivery. Hidden defects must be reported to the seller in writing immediately, but no later than 3 days after discovery. If the buyer fails to report them in a timely manner, his claims expire. After returning the goods complained about, the buyer will receive a replacement delivery if there is a defect. If a replacement delivery is not possible, the seller will refund the payment made. In addition, any claim for reduction, conversion or compensation for consequential damage caused by a defect is excluded, to the extent permitted by law. No liability is accepted for transport damage or shipment losses and must be reported directly to the shipping service provider.

The buyer forfeits any rights to defects if the goods are used improperly. Defects resulting from normal wear and tear, as well as those resulting from improper handling or damage by the buyer or third parties, and defects that are attributable to external circumstances (improper storage, frost, heat, moisture, incorrect storage, etc.) do not entitle the buyer to withdraw from the contract or to replace the goods. The seller assumes no liability for this. Returns of goods are at the buyer's expense and risk. The products must be properly packed in the original packaging and sent by registered mail. If the seller cannot identify any defects that are covered by the warranty or are covered by the manufacturer's guarantee, the seller can charge the buyer for the costs of inspecting and shipping the goods.

Other claims by the buyer - regardless of the legal basis - are excluded to the extent permitted by law. The seller, its assistants and any vicarious agents are not liable for damages that did not arise from the goods themselves, in particular not for consequential damages, lost profits or other financial losses of the buyer. Any liability of the seller in connection with the offer (in particular incorrect images, texts and prices) and the delivery is excluded to the extent permitted by law.

Products ordered by the buyer by mistake will not be taken back or refunded.

Disclaimer

Exclusion of any liability regarding products, effects, intolerances, unwanted side effects, damage and consequential damage. First test treatments on an inconspicuous area are recommended to test compatibility. If you have known intolerances or allergies, avoid the corresponding ingredients or discuss them with a doctor beforehand.

The Seller expressly reserves the right to adapt these General Terms and Conditions at any time and to apply them immediately.

All contracts concluded with the seller are subject to Swiss law, excluding the substantive rules of conflict of laws and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
